La commission de l'équipement et des services de la chambre des députés procèdera cet après midi à l'audition de Mr Abdelhamid triki, Directeur de l'Institut de l'économie quantitative, en tant qu'expert à propos du projet de loi mentionné au titre.
L'audition des experts n'est pas assez réglementée par le règlement intérieur de la chambre. En effet, le seul article sur lequel on se base pour y procéder est l'article 42 qui autorise la commission à demander l'audition d'un membre du gouvernement ou "se faire éclairer par toute personne qu'elle juge utile"!!!
L'audition des experts auprès de la chambre et ses commissions permanentes se fait rare. Seuls quelques projets d'une certaine complexité ont poussé certaines commissions à demander les avis des experts.
Dans ce cas d'espèce, la commission de l'équipement et des services a innové par le fait qu'elle a bien précisé le cadre dans lequel elle procède à l'audition. En effet, ce n'est pas à propos du projet de loi en tant que tel qu'elle va auditionner l'expert, mais c'est plutôt à propos de l'économie numérique et des activités à haute valeur ajoutée.
C'est comme la commission s'est inspirée des règles du code de procédure civile et commerciale pour assigner à ses membres et à l'expert le domaine de l'audition.
Il serait judicieux que le règlement de la chambre fixerait les règles des auditions des experts dans le sens de plus de précisions et de clarté.
Cela suppose que l'expert n'aura pas besoin du projet de loi et ses articles pour répondre aux différentes questions que vont lui poser les députés. La coutume, interdit qu'une copie du dit projet lui soit remise. Mais Mr Abdelhamid triki est membre du conseil économique et social qui s'est prononcé sur le dit projet et avait transmis son avis à la chambre. L'expert connaît-il donc le projet? Pas celui transmis par le gouvernement à la chambre car le conseil économique et social ne transmet pas avec son avis, le texte du projet sur lequel s'est prononcé, et l'expérience a prouvé qu'entre le projet transmis au conseil et celui transmis à la chambre, des différences peuvent y exister. Fallait-il aussi que le conseil transmet à la chambre non seulement son avis, mais aussi le texte qui lui a été transmis.

The expert does it know therefore the project? No. the one transmitted by the government to the room for the economical and social counsel does not transmit with his opinion, the text of the project on which pronounced itself, and the experience proved that between the transmitted project to the counsel and the one transmitted to the room, differences there can exist. It was necessary also as the counsel transmits to the room not only his opinion, but also the text that was transmitted for him.
